What is a Division Order?

The division order sets forth the decimal interest of production owned by each party, their address and a legal description of the property on which the well is located. The division order is not a legal document, it is a courtesy notice, notifying you that we have drilled and are receiving production on mineral interest that you own. By signing the division order, you agree to the owner information and decimal interest on said form.
How is my interest calculated?

The decimal interest on your division order is calculated by dividing the number of mineral acres you own by the total number of acres in the unit, multiplied by your lease royalty percentage.
Example:
You own a 50% mineral interest under 480 acres in a 1280-acres spacing unit and you have leased that acreage at a 1/8th royalty.
The calculation would be as follows:
50% x 480 / 1280 x (1/8th) = 0.0234375
Your ownership would be shown in decimals rather than as a percentage. (0.0234375 vs. 2.34375%)
What is an “owner number” where can it be found and what is its purpose?

Anschutz assigns each of its interest owners a unique owner number for internal identification purposes. Please include your owner number when communicating or corresponding with Anschutz. The owner number can be located on your check. Also, the owner number is located on your division order on the right side inside the bold box.
When are checks issued?

Typically, we run our revenues at the end of each month. Please allow until the 10th of the month to receive your check.
What do I do if I find a check that is more than 90 days old?

Our bank will not honor checks that have been outstanding for more than 90 days. If an owner discovers that its check is stale dated, they should return the check to Anschutz Attention: Accounting Department. If the returned check has not previously been reissued to the owner, it will be voided, and the entire amount of the check will be credited to the owner’s account or sent in the mail. This will happen on the next regularly schedule check process.
How can I sign up for electronic transfer?

Not at this time. However, Anschutz Exploration Corporation is currently working to make this option available soon. Our goal is to roll this option out to our owners by early 2022.
How do I update my owner information?

Please provide Anschutz with a written request to change your name. Your request should include your old name as it appears in our records, your new name, and a court certified copy of the marriage certificate, divorce decree, or court ordered name change.
What happens if an interest owner passes away?

Please contact Anschutz's Division Order Department in writing so that we may place the account in suspense pending the outcome of probate.
If the owner dies with a Will (testate) and probate proceedings have been or will be conducted in the state where the property is located, please provide the following:

* Certified copy of Death Certificate
* Order Issuing Letters Testamentary
* Order admitting Will to Probate
* Final decree, Judgement or Personal Representative Deed distributing the estate

If the owner dies with a Will (testate) and probate proceedings have been or will be conducted in a state other than the state where the property is located, please provide the following:

* Certified copy of Death Certificate
* Documentation of ancillary probate proceedings opened in all affected counties.
* Final decree, Judgement or Personal Representative Deed distributing the estate

If the owner dies without a Will (intestate), please provide the following:

* Certified copy of Death Certificate
* If an owner dies intestate, please contact an attorney in the state in which the property is located to determine requirements for settling the estate and transferring the owners interest.

ALL DOCUMENTS AFFECTING CHANGE OF OWNERSHIP MUST BE FILED OF RECORD IN THE COUNTY WHERE THE PROPERTY IS LOCATED.
What documents are required if I buy or sell an interest in a property?

You should provide Anschutz’s Division Order Department with a recorded copy of the deed, assignment, or other instrument of conveyance properly recorded in the county in which the property is located.
When will I recieve my Form 1099 for income tax purposes?

Form 1099’s will be mailed via the United States Postal Service on or before January 31st each year for the preceding calendar year. Please allow ten (10) business days for the form to arrive to your address.

APD and Spacing

I have received a Horizontal Well Application in the mail, what is this, why did I get it, and do I need to do anything?

A Horizontal Well Application has been forwarded to you as preliminary title indicates you are either a Working Interest Owner or Mineral Owner within a one-half mile radius of the proposed wellbore. This is a standard, informational notice necessary for permitting purposes pursuant to Chapter 3, Section 8 (f) of the State of Wyoming Oil and Gas Conservation Commission (“WOGCC”), in which we are required to provide notice to each such owner. This is not a notice of a well being drilled. The WOGCC’s requirements can be found via the following link:

I have received a Drilling and Spacing Application in the mail, what is this, why did I get it, and do I need to do anything?

A Drilling and Spacing Application has been forwarded to you as preliminary title indicates you are either a Working Interest Owner or Mineral Owner inside or within a one-half mile of the proposed Drilling and Spacing Unit. This is a standard, informational notice pursuant to Chapter 5, Section 5 of the State of Wyoming Oil and Gas Conservation Commission (“WOGCC”), in which we are required to provide notice to each such owner. The WOGCC’s requirements can be found via the following link:

I have received a Statutorily Pooling Application in the mail, what is this, why did I get it, and do I need to do anything?

Anschutz applies for Statutorily Pooling when complete commitment from Working Interest Owners or Unleased Mineral Owners to participate for their proportionate share in the drilling, completing, and equipping of a well has not been received. Anschutz is required to notify all Working Interest Owners and Unleased Mineral Owners in the proposed well, regardless of their election. Please refer to the Well Proposal previously sent to you or contact Anschutz at Owner.Relations@aec-denver.com should you have any additional questions.
A notice of an application was sent to my address, but it is not addressed to me, what do I do?

If you are receiving mail that is addressed to a person or entity that is not you, or you are not familiar with, please disregard and discard. If this issue continues, please reach out to Anschutz at Owner.Relations@aec-denver.com and include your name, the name of the party the mail is addressed to, and the address at which you are receiving the mail. We will do our best to not send any further correspondence for that entity to the address you provide.
I am an interest owner and applications have been delivered to the wrong address, what do I do?

Anschutz pulls all addresses from the County Clerk and Recorder. If your current address has not been filed with the County Clerk and Recorder, please submit for recording, and provide a recorded copy to Anschutz. We are unable to provide a recording template, but can recommend you contact the County Clerk and Recorder or an oil and gas attorney for guidance.
